1. Introduction

These Terms and Conditions govern your use of Memorial.tv, a digital platform that allows families and friends to create private memorial spaces where they can collect, display and preserve photos, videos, messages and other memories of a loved one.

By creating, accessing or contributing to a memorial space, you agree to these Terms. If you do not agree with these Terms, you should not use Memorial.tv.

2. Service Provider

Memorial.tv is operated by Juga Entertainment S.L., Calle Bailen 11, Barcelona 08013, Spain.

3. Description of the Service

Memorial.tv allows a memorial page administrator to create a private digital space and invite contributors through a link, code or QR code. Contributors may upload photos, videos and written messages. The collected memories may be displayed in a web gallery, slideshow or downloadable archive, depending on the selected plan and available features.

Memorial.tv is designed for personal, family and commemorative use. It is not intended as a permanent archival institution, legal repository or official record.

4. Accounts and Access

The person who creates a memorial page is responsible for managing access, inviting contributors and moderating the memorial space. You are responsible for keeping your login details and private access links secure.

Contributors should only access a memorial space if they have been invited or authorised by the memorial page administrator.

5. User Content

You retain ownership of the photos, videos, messages and other content you upload to Memorial.tv. By uploading content, you grant Memorial.tv the limited rights necessary to host, process, display, transmit, store and make that content available within the memorial space.

You confirm that you have the necessary rights and permissions to upload and share the content you submit, including any rights related to images, videos, personal data and the people appearing in them.

6. Respectful Use

Memorial.tv is intended to be used in a respectful and sensitive context. You agree not to upload or share content that is unlawful, offensive, abusive, hateful, defamatory, threatening, invasive of privacy, sexually explicit, violent, discriminatory, misleading or otherwise inappropriate for a memorial space.

We may remove content or restrict access if we believe these Terms have been violated or if content may harm other users or the integrity of the Service.

7. Moderation

Memorial page administrators may review, approve, edit, hide or delete submitted content, depending on the features available in their plan. Memorial.tv may also use automated or AI-assisted moderation tools to help identify potentially inappropriate content.

Automated moderation is not perfect. The memorial page administrator remains responsible for reviewing the content shared in their memorial space.

8. Privacy and Personal Data

We process personal data in accordance with our Privacy Policy. Because memorial pages may contain personal and emotionally sensitive content, administrators should invite only trusted people and should carefully manage access to each memorial space.

Please do not upload personal data, photographs or videos of other people unless you have a lawful basis or appropriate permission to do so.

9. Payments and Plans

Some features of Memorial.tv may require payment. Prices, limits, features and storage periods are shown on the pricing page at the time of purchase. Unless otherwise stated, payments are made for the selected memorial page or plan.

We may change prices or features in the future, but changes will not affect already purchased plans during their active period, except where required by law or necessary for security or technical reasons.

10. Storage and Availability

Memorial.tv may store uploaded content for the period associated with the selected plan. We recommend that administrators download and keep their own backup of important memories.

While we aim to provide a reliable service, we cannot guarantee uninterrupted access, permanent availability or error-free operation at all times.

11. Downloads and Printed Products

Depending on the available features, administrators may be able to download uploaded memories or generate printable materials. It is the administrator’s responsibility to review downloaded or printed content before sharing, publishing or printing it.

12. Intellectual Property

Memorial.tv, its design, software, interface, branding and related materials are owned by Juga Entertainment S.L. or its licensors. You may not copy, modify, reverse engineer, resell or exploit the Service without our permission.

13. Limitation of Liability

Memorial.tv is provided on an “as is” and “as available” basis. To the maximum extent permitted by law, we are not liable for indirect, incidental, special or consequential damages, loss of data, emotional distress, loss of profits or damages resulting from the use or inability to use the Service.

Nothing in these Terms limits any liability that cannot be limited under applicable law.

14. Suspension or Termination

We may suspend or terminate access to Memorial.tv if we believe that these Terms have been violated, if the Service is misused, if payment obligations are not met, or if required for security, legal or technical reasons.

15. Changes to These Terms

We may update these Terms from time to time. The updated version will be published on this page with a new “Last updated” date. Continued use of Memorial.tv after changes are published means that you accept the updated Terms.

16. Governing Law

These Terms are governed by the laws of Spain, without prejudice to any mandatory consumer protection rights that may apply in your country of residence.
